The objective of this article is to compare and contrast the influential notion of natural and property rights created by John Locke in his "Second Treatise on Government" (1689) to the posterior notion of abstract right expressed by Georg Wilhelm Friedrich Hegel in his "Elements of the Philosophy of Right". Said analysis is particularly pertinent given the complexity of Hegel’s political philosophy, and, perhaps more importantly, seeing as Hegel’s abstract right was (allegedly and in part) intended to point out the (...) shortcomings of Locke’s theory of natural and property rights, in order to further the human understanding of the world. More specifically, this article will examine the two rights theories in terms of their respective amounts of emphasis on individualism, or lack thereof. It will reveal three areas in which Lockean rights are more geared towards the primacy of the individual than Hegelian rights: (1) in their respective understandings of what it means to be a person, (2) in their conduciveness to individual wellbeing through the obligations each theory entails, and (3) in the extent of the rights themselves in relation to the state. Aspásia de Mileto (470?-400?) é uma figura cuja história nos é nebulosa e ao mesmo tempo muito clara. Nebulosa pois, como sugere Marta Andrade (2022, p. 24), trata-se de uma existência, como muitas outras, cuja memória a posteridade raramente se ocupou ou simplesmente esqueceu. Mas também clara pois Aspásia possui uma persona constituída no que chamamos de "tradição". A amante de Péricles. A professora de Sócrates. A esposa de Lísicles. Sua figura é frequentemente resgatada à sombra das figuras masculinas com (...) as quais se envolveu. Em grande medida porque as fontes que a resgatam trazem seu nome à margem, mas também em parte devido a uma postura metodológica que, por vezes, ignora nomes de mulheres. Neste artigo, viso recorrer às fontes para trazer à tona o protagonismo de Aspásia no que tange à educação e seu pioneirismo no pensamento retórico. Na primeira seção, desenvolverei uma breve biografia de Aspásia, sua possível influência política e suas habilidades pedagógicas. Na segunda seção, tratarei especialmente de suas contribuições para a retórica, abordando o discurso atribuído a si no Menêxeno de Platão e a Oração Fúnebre atribuída a Péricles por Tucídides. Por fim, na conclusão, diante das teses desenvolvidas, chegaremos a uma imagem mais digna de Aspásia, vislumbrando o retrato de uma mulher que dirige um elogio à coragem e cuja opinião incide diretamente em seu corpo social e político. Desse modo, compreenderemos melhor seus avanços nos âmbitos pedagógicos e retóricos, tidos como cruciais para o desenvolvimento dos cidadãos gregos. (shrink)

O presente artigo tem como objetivo principal esclarecer a concepção da tradição megárica acerca do conceito de capacidade (δύναμις), tal como apresentada no livro Theta da Metafísica de Aristóteles. A análise se faz necessária devido à falta de atenção aristotélica na formulação da tese adversária dos megáricos, pois em nenhum momento Aristóteles parece nos oferecer argumentos plausíveis que justifiquem de maneira adequada a tese de seus oponentes. Partindo desta dificuldade de reconstrução do argumento megárico e visando lhe oferecer uma maior (...) dignidade, o estudo irá, em primeiro lugar, destrinchar possíveis argumentos que sustentem a tese no contexto da referida obra. Em seguida, irá provar que, mesmo a tese megárica não sendo tão facilmente refutável como uma primeira leitura poderia sugerir, há em sua estrutura problemas graves, que se evidenciam diante da concepção aristotélica da capacidade. In his Lectures on Fine Art (1835), Hegel emphasizes the grotesque character of Indian art. Grotesqueness results, in his view, from a contradiction between meaning and shape due to the incongruous combination of spiritual and material elements. Since Hegel's history of art is teeming with examples of inadequacy between meaning and shape, this paper aims to distinguish the grotesque from other types of artistic dissonance and to problematize Hegel's ascriptions of grotesqueness to ancient Indian art. In the first part of (...) the paper, I characterize the grotesque by the unnatural distortion of natural shapes with the purpose of achieving a direct sensuous manifestation of an indeterminate and impersonal divinity, Brahman. Such an attempt is, in Hegel's view, self-contradictory and self-defeating, leading to an exaggeration of the conflict between nature and spirit instead of the intended reconciliation between the two parts. In the second part of the paper, I compare Hegel's account of Indian art to the ‘monstrous myths’ of early modern Europe. Unlike his predecessors, Hegel legitimizes the grotesque representations of Hindu gods as endowed with profound meaning and the result of a universal human need, yet he describes them as ultimately irrational and repulsive based on a prejudiced view of the Indian people(s). In this sense, Hegel's assessment of Indian art functions as a reflection of modern European culture, its fascination and horror in the face of what Enlightenment could not entirely purge, rather than as a truthful and objective account of Indian art and culture. By questioning Hegel's characterization of Hindu iconography and mythology, this paper contributes to underexplored areas of Hegelian aesthetics, namely Hegel's account of symbolic art, especially Indian art, as well as his views on negative aesthetic experiences and values. É relativamente recente a perspectiva revisionista dos intentos filosóficos de Platão. Apesar disso, a ideia de um filósofo preocupado apenas em construir um edifício sistemático e hermético tem se mostrado cada vez menos sustentável, principalmente quando se observam as diversas fontes que apontam para interesses que não se restringem à filosofia, bem como para o desenvolvimento dos aspectos dramáticos presentes no corpus platônico como um todo. A ideia de que a literatura tem uma influência na obra platônica parece clara e (...) um consenso entre os estudiosos, visto as inúmeras referências que Platão faz, por exemplo, à poesia épica nas figuras de Homero e Hesíodo. Mas pouco parece ter sido dito a respeito do inverso: da influência que Platão poderia ter exercido na literatura posterior. Visando lidar com esse obscurecimento, o presente estudo tem como intento primordial identificar e analisar a possível existência de elementos platônicos em dois romances do período imperial grego, a saber, em Quéreas e Calírroe de Cáriton de Afrodísias e em Dáfnis e Cloé de Longo. Em seguida, intenta demonstrar de que modo Platão, ao exercer uma clara influência na literatura posterior, deixou atrás de si não somente o já reconhecido legado filosófico, mas contribuiu substancialmente para o desenvolvimento da atividade literária, efetuando uma síntese complexa entre filosofia e literatura, ao mesmo tempo em que nos leva a questionar a suposta rigidez inflexível que as distinguem. O objetivo deste artigo é defender uma leitura “inclusiva” da Scala Amoris (210a-212b) presente no Banquete de Platão, na qual o amante, em sua ascensão, incorpora um número cada vez maior de objetos belos em sua esfera de preocupação erótica. Neste sentido, posiciono-me de forma contrária à leitura “exclusiva”, na qual tal ascensão implicaria o abandono do que fora anteriormente desejado.

O objetivo deste estudo é propor um modelo explicativo ao problema da beleza desenvolvido no diálogo Hípias Maior de Platão. É um lugar-comum entre os estudiosos defender o senso aporético do diálogo, ressaltando como todas as hipóteses formuladas são descartadas pelos interlocutores, tese que é geralmente endossada pela afirmação final de que as coisas belas são difíceis (304e8). No entanto, no epicentro deste emaranhado de hipóteses, algumas conclusões importantes surgem e serão, conforme se espera demonstrar, fortemente incorporadas em outros lugares (...) daquilo que chamamos de corpus platônico. Assim, a partir desta condição fragmentária, inerente ao próprio texto, e através dela mesma, a presente dissertação visa propor um senso de unidade ao diálogo. Para cumprir tal intento, defende-se que a estrutura do diálogo repousa em três características centrais, sendo estas responsáveis por qualificar o belo em si, são elas: a ordem (kalós é identificado com o kósmos, a ordem, à medida em que estabelece um principio estético de organização, garantindo a ordem harmônica dos seres); a admiração (isto é, o objeto perseguido tem uma validade permanente e universal de estima e, neste sentido, aparece conectado àquilo que é genuinamente bom (agathós), embora a ele não se limite); e, por fim, o comum (kalós é identificado com o koinós, o comum, pois é apresentado como aquilo que é compartilhado pelas coisas belas). A partir destas atribuições, espera-se alcançar uma designação apropriada do belo, de modo a conferir uma certa dignidade e prestígio a um diálogo pouco abordado nos estudos platônicos. (shrink)

In this paper I argue that, in addition to having an obligation to resist the oppression of others, people have an obligation to themselves to resist their own oppression. This obligation to oneself, I argue, is grounded in a Kantian duty of self-respect.

Catharine Trotter Cockburn’s metaphysics dissolves the necessary relationship between immateriality, immortality and thought. While in her youth this leads her to admit the possibility of thinking matter, in her mature work, it allows her to conceive space as non-thinking immaterial substance that links non-thinking material substance and thinking immaterial substance. To ground this conception of space, she draws on the thesis of the great chain of being. However, the possibility of thinking matter is not consistent with the hierarchy of beings, (...) because within this frame matter occupies the lowest place. My aim is to evaluate whether there is any alternative within Trotter's philosophy to solve this contradiction. -/- La metafísica de Catharine Trotter Cockburn disuelve la relación necesaria entre inmaterialidad, inmortalidad y pensamiento. Mientras que en su juventud esto la lleva a admitir la posibilidad de la materia pensante, en su madurez le permite concebir al espacio como sustancia inmaterial no pensante que oficia como eslabón entre la sustancia material no pensante y la sustancia inmaterial pensante. Para ello, apela también a la tesis de la gran cadena del ser. Sin embargo, la posibilidad de la materia pensante no es consistente con la tesis de la jerarquía de seres, porque en ella la materia ocupa el lugar más bajo. Me propongo estudiar si existe alguna alternativa dentro de la filosofía de Trotter que permita resolver esta contradicción. (shrink)

This dissertation critically examines the writings of Max Stirner, especially his masterpiece The Ego and Its Own, as a discourse of resistance against modern forms of domination and, in particular, against the modern political State. I begin by examining Stirner's inversion of the Hegelian concept of the State, from the “actualization of freedom”to an instance of domination. The State appears, to Stirner as to Hegel, as the guardian of order and cohesion in modern societies. While both recognize the genesis of (...) sovereign power as violent, Hegel sustains that, with the progress of civilization, force is eradicated from the public order and private interests and common interest are reconciled. Stirner, on the contrary, insists that force is the other face of right, as the hidden pillar of the norm, which only reveals itself in moments of crisis. Stirner’s focus on the extreme case, largely anticipated and devalued by Hegel as unilateral and equivocal, seems to be anchored on the conviction that conflict is ineradicable, that between my own will and the (political, social) representation of that will there is always a gap, which cannot be filled by any collective arrangement. From this follows that, if conflict is scarcely manifest in modern societies, it is not because it was truly solved, but because it is effectively masked, due to the dissymmetry of power and the internalization of authority. The “unique one” appears, in this environment of great suspicion, as the one who cannot be represented, who surpasses every representation, threatening the authority of every representative. Accordingly, the “unique one” reclaims his own power, without allowing the satisfaction of his will to be mediated by obedience to collective institutions, affirming himself instead as sovereign over himself. Stirner suggests that the self-affirmation of the “unique one” inevitably leads to confrontation with the external powers that organize his existence. Stirner, nonetheless, chooses to think this confrontation in terms of a “revolt”, of a reflexive and individual act by which the individual emerges from the situation in which he finds himself, rather than as a “revolution”, a political or social act directed towards the systemic transformation of the status quo. Even if we admit the validity of the Stirnerian critique of the legitimizing discourses of modernity, the problem remains if this critique can be sustained on the “unique one”, “a thoughtless word”, an openly self-contradictory and self-destructive name, subject or principle (?). The possibility of founding a discourse of resistance on the egoism of Max Stirner seems to depend upon the answer that we choose to give to two intimately connected questions: what remains after the destructive vortex of the “unique one” that may sustain the resistance against a state that Max Stirner deems oppressive? Can this resistance be realized in the revolt of a unique one without the recognition of another one with whom to build the conditions of freedom? (shrink)

With the increasing degrees A.I.s and machines are applied across different social contexts, the need for implementing ethics in A.I.s is pressing. In this paper, we argue for a pluralist hybrid model for the implementation of moral A.I.s. We first survey current approaches to moral A.I.s and their inherent limitations. Then we propose the pluralist hybrid approach and show how these limitations of moral A.I.s can be partly alleviated by the pluralist hybrid approach. The core ethical decision-making capacity of an (...) A.I. based on the pluralist hybrid approach consists of two systems. The first is a deterministic algorithm system that incorporates different moral rules for making explicit moral decisions. The second is a machine learning system that calculates the value of the variables required by the application of moral principles. The pluralist hybrid system is better than the existing proposals as (i) it better addresses the moral disagreement problem of the top-down approach by including different moral principles, while (ii) it reduces the opacity of ethical decision-making compared with a bottom-up system by implementing explicit moral principles for moral decision making. This paper considers why obtaining and sustaining a good sexual life tends to be so challenging and why the temptation to settle for a bad one can be so alluring. We engage these questions by cultivating ideas found in the traditions of feminist philosophy and the philosophy of sex and love in dialogue with the works of two unlikely, canonical bedfellows—Immanuel Kant and Hannah Arendt. We propose that some sources of these challenges and temptations are patterned and manifold in that (...) they involve trying to transform, develop, integrate certain unruly emotional structures in oneself, including together with others. Other equally patterned and unruly sources track inherited oppressive or oppressed behaviors and feelings that make emotionally healthy, morally responsible realizations of sexual ways and being more difficult for all parties involved. In contrast to these patterned challenges, some difficulties that face us stem from the fact that humans are genuinely different from one another and evolving—individually, jointly, and collectively—in their sexual needs and wants. News about personal data breaches or data abusive practices, such as Cambridge Analytica, has questioned the trustworthiness of certain actors in the control of personal data. Innovations in the field of personal information management systems to address this issue have regained traction in recent years, also coinciding with the emergence of new decentralized technologies. However, only with ethically and legally responsible developments will the mistakes of the past be avoided. This contribution explores how current data management schemes are insufficient to (...) adequately safeguard data subjects, and in particular, it focuses on making these data flows transparent to provide an adequate level of accountability. To showcase this, and with the goal of enhancing transparency to foster trust, this paper investigates solutions for standardizing machine-readable policies to express personal data processing activities and their application to decentralized personal data stores as an example of ethical, legal, and technical responsible innovation in this field. This paper is an attempt to identify certain consonances between contemporary liberalism and classical pragmatism. I identify four of the most trenchant criticisms of classical liberalism presented by pragmatist figures such as James, Peirce, Dewey, Addams, and Hocking: that liberalism overemphasizes negative liberty, that it is overly individualistic, that its pluralism is suspect, that it is overly abstract. I then argue that these deficits of liberalism in its historical incarnations are being addressed by contemporary liberals. Contemporary liberals, I show, have (...) taken on board a surprising number of classical pragmatist insights and have responded to a surprising number of classical pragmatist criticisms. I thus argue that both contemporary pragmatism and contemporary liberalism have much to gain by joining forces. (shrink)

A reluctance to be guilty of blaming the victims of harassment, coupled with other normative considerations that tell in favor of the unfairness of this sort of obligation, might make us think that women never have an obligation to confront their harassers. In this paper I consider the possibility that failing to fulfill the Kantian obligation to protect one’s rational nature might actually vitiate future instances of this obligation. I respond to this dilemma by defending a novel interpretation of Kant’s views on the relation between the value we have and the respect we are owed. I argue, contra the received view among Kant scholars, that the feature in virtue of which someone has unconditional and incomparable value is not the same feature (...) in virtue of which she is owed the respect that constrains how she may be treated. So, even though someone who fails to attempt to protect her rational nature fails to respect herself in the right way, and even though this moral failing does make her lose a certain kind of value, her obligations to respect herself do not go away. The Situationist International (1957-1972) was a small group of communist revolutionaries, originally organised out of the West European artistic avant-garde of the 1950s. The focus of my thesis is to explain how the Situationist International (SI) became a group able to exert a considerable influence on the ultra-left criticism that emerged during and in the wake of the May movement in France in 1968. My wager is that the pivotal period of the group is to be found between 1960 and (...) 1963, a period marked by the split of 1962. Often this is described as the transition of the group from being more concerned with art to being more concerned with politics, but as I will argue this definitional shorthand elides the significance of the Situationist critique of art, philosophy and politics. The two axes of my thesis are as follows. First, that the significant minority in the group which carried out the break of 1962, identified a homology between the earlier Situationist critique of art — embodied in the Situationist ‘hypothesis of the construction of situations’ — and Marx’s critique and supersession of the radical milieu of philosophy from which he emerged in the mid- 1840s. This homology was summarised in the expression of the Situationist project as the ‘supersession of art’ (dépassement de l’art). Secondly, this homology was practically embodied in the resolution of the debates over the role of art in the elaboration of the Situationist hypothesis, which had been ongoing since 1957. However, it was the SI’s encounter with the ultra-left group Socialisme ou Barbarie that would prove decisive. Via Guy Debord’s membership, the group was exposed to both the idea of a more general revolutionary criticism, but also ultimately what was identified as the insufficiently criticised ‘political militancy’ of this group. Indeed, in the ‘political alienation’ found in Socialisme ou Barbarie, a further homology was established between the alienation of the political and artistic avant-gardes. This identity would prove crucial to the further elaboration of the concept of ‘spectacle’. By way of an examination of the peculiar and enigmatic ‘Hamburg Theses’ of 1961, and the relationship between these ‘Theses’ and the Situationist criticism of art and politics worked out over the first five years of the group, I will argue that the break in 1962 should be conceived as one against politics as much as art (rather than just the latter, as it is more often represented). Additionally, I will outline how the SI, through the paradoxical reassertion of their artistic origins, attempted to synthesise their criticism of art with the recovery of the work of Marx beyond its mutilation as Marxism. Indeed, it was the synthesis of these critiques that enabled the considerable development of the concept of ‘spectacle’, opening the way to the unique influence the SI exerted in the re-emergence of a revolutionary movement at the end of the 1960s. This paper explores relationships between environment and education after the Covid-19 pandemic through the lens of philosophy of education in a new key developed by Michael Peters and the Philosophy of Education Society of Australasia. The paper is collectively written by 15 authors who responded to the question: Who remembers Greta Thunberg? Their answers are classified into four main themes and corresponding sections. The first section, ‘As we bake the earth, let's try and bake it from scratch’, gathers wider philosophical (...) considerations about the intersection between environment, education, and the pandemic. The second section, ‘Bump in the road or a catalyst for structural change?’, looks more closely into issues pertaining to education. The third section, ‘If you choose to fail us, we will never forgive you’, focuses to Greta Thunberg’s messages and their responses. The last section, ‘Towards a new normal’, explores future scenarios and develops recommendations for critical emancipatory action. The concluding part brings these insights together, showing that resulting synergy between the answers offers much more then the sum of articles’ parts. With its ethos of collectivity, interconnectedness, and solidarity, philosophy of education in a new key is a crucial tool for development of post-pandemic education. (shrink)

Colombia celebra en el año 2006 los quince años de la promulgación de su Constitución Política, y los cambios de trascendentales surgidos a partir de su aplicación has sido prolíficos, Particularmente, el tema ambiental ha sobresalido dentro de las grandes transformaciones del país, y por ello no en vano hoy se afirma que tenemos una verdades Constitución ecológica. De igual forma, la Facultad (...) de Jurisprudencia de la Universidad del Rosario conmemora los die años de la creación de la especialización en Derecho Ambiental, y tal coincidencia histórica fue una motivación adicional para proponer la realización de un análisis de la evolución normativa surtida para proponer la realización de un análisis de la evolución normativa surtida en este decenio, una evaluación de la gestión ambiental colombiana y de sus distintos impactos en una sociedad que cuenta hoy en día con herramientas constitucionales legales para la defensa de sus derechos e interese colectivos. La Universidad del Rosario ha sido parte de esta evolución, desarrollando un rol activo con el cual se han abierto espacios de discusión y de proposición de alternativas, herramientas y experiencias en pro de la protección integral de la diversidad étnica, cultural y natural de la Nación colombiana. Así, se ha constituido como facilitadora del proceso de la formación de los nuevos actores y ha tenido gran posicionamiento en procesos de participación y de estructuración de proyectos institucionales ambientales. This study explores the employee retention strategies implemented by administrators in educational institutions, focusing on Immaculate Conception College of Balayan, Inc. The qualitative case study involved 10 participants, including administrators and employees selected based on stable tenure and appropriate qualifications. Through face- to-face interviews, key determinants influencing retention, such as teacher satisfaction, job contentment, professional growth, and loyalty, were identified. Recognition and incentives emerged as the primary retention strategy, significantly influencing employee satisfaction and fostering a sense of belonging. The study (...) concludes that these strategies are effective, contributing to the retention of skilled professionals. Recommendations emphasize the importance of recognizing and providing incentives as core strategies for administrators in educational settings, recognizing their role in creating a positive work environment and promoting sustained employee commitment. The theme this year is "Towards an Open Ontology Repository". This communiqué represents the joint position of those who were engaged in the year's summit discourse on an Open Ontology Repository (OOR) and of those who endorse below. In this discussion, we have agreed that an "ontology repository is a facility where (...) ontologies and related information artifacts can be stored, retrieved and managed." -/- We believe in the promise of semantic technologies based on logic, databases and the Semantic Web, a Web of exposed data and of interpretations of that data (i.e., of semantics), using common standards. Such technologies enable distinguishable, computable, reusable, and sharable meaning of Web and other artifacts, including data, documents, and services. We also believe that making that vision a reality requires additional supporting resources and these resources should be open, extensible, and provide common services over the ontologies. (shrink)

Pocos otros temas despiertan más polémicas que el de los vínculos entre filosofía y política: que quienes se dedican a la filosofía no deben verse influenciados por la política, que si a la política le corresponde ser auxiliada por la filosofía, que si el saber filosófico tiene que desligarse de las posiciones políticas, que si a las instituciones académicas de las humanidades les conviene independizarse del poder de turno, etc. Todas estas son discusiones que heredamos (no sin reformularlas y, por (...) lo tanto, retransformarlas) desde la Antigüedad, en la que ya aparecería, de la mano de Platón, la figura del rey filósofo. Este libro reúne una variedad de abordajes que atraviesan debates sobre juicios de hecho y de valor, sobre la democra-cia como forma de gobierno y sobre la intervención de la historia en el vínculo de la filosofía y la política. Recuperando el pensamiento antiguo y moderno, pero concentrándose en la obra de intelectuales contemporáneos, los autores ponen en movimiento dilucidaciones de grandes como Max Weber, Jacques Rancière, Louis Althusser, Philippe Lacoue-Labarthe y Leo Strauss, entre otros. In this paper I will examine the relationship between constitutionalism and democracy as the alleged tensions between them appear in diagnoses about the crisis of liberal democracy. The issue is approached through the arguments of the German jurist Martin Kriele, who holds the thesis that there can be no sovereign in the constitutional State. I will begin by explaining this thesis as well as the justification offered by Kriele. According to him, the guarantee of rights and freedoms is only possible (...) within the framework of the constitutional State. Hence, he advances a second related thesis, that democracy can only be developed in the constitutional State, that is, as constitutional democracy. However, this second thesis seems in contradiction with the first if the democratic principle implies popular sovereignty. To resolve this apparent antinomy, I will distinguish with Kriele two rival conceptions of democracy in order to point out the danger of misinterpreting the meaning of constitutional democracy. -/- En este trabajo examino la relación entre constitucionalismo y democracia, puesto que las supuestas tensiones entre ambos aparecen en los diagnósticos sobre la crisis de la democracia liberal. La cuestión se aborda a través de los argumentos del jurista alemán Martin Kriele, quien defiende la tesis de que no puede haber soberano en el Estado constitucional. Empezaré por explicar dicha tesis así como la justificación de ella que ofrece Kriele, para quien la garantía de los derechos y libertades sólo es posible en el marco del Estado constitucional. De ahí que avance una segunda tesis relacionada, cuando sostiene que la democracia sólo puede desarrollarse en dicho Estado constitucional, esto es, como democracia constitucional. The central role of gestural language in Buddhism is widely acknowledged, as in the story of the Buddha pointing at the moon, the point being the student’s seeing beyond the finger to its gesture. Gesture’s role in dance is similarly central, as noted by scholars in the emerging interdisciplinary field of dance studies. Unsurprisingly, then, the intersection of these two fields is well-populated, including the formal gestures Buddhism inherited from classical Indian dance, and the masked dance of the Mani Rimdu (...) Festival. In this investigation, I will articulate a new Buddhist philosophy of gestural language, based on a new conception of emptiness that I locate in the work of contemporary U.S. choreographer Deborah Hay, as influenced by Nāgārjuna and Zen. And this, finally, suggests that contemporary Western philosophy should incorporate this compassion as a normative dimension to its own theorizing and practice. (shrink)

If the review had engaged more closely with the arguments of EfL and been more informed by the relevant social scientific literature, then it would probably have found the anarcho-libertarian case to be far more robust and realistic than such a (...) cursory dismissal can hope to refute. La memética constituye un enfoque sobre la evolución cultural que se ha encontrado en el foco de la discusión y recolectado críticas de diverso tipo en las últimas décadas. El propósito de nuestro trabajo consiste en indagar si, más allá de las críticas y defensas existentes, puede considerarse que existe actualmente algún programa de investigación que pueda caracterizarse adecuadamente como memético. Nos centraremos, específicamente, en el ámbito del estudio de la evolución cultural de los cantos de aves, pues allí algunos (...) autores han utilizado la palabra «meme» para referirse a los ítems culturales bajo estudio. Sin embargo, no todos utilizan la palabra, pues, probablemente por su carácter controversial, ha caído en desuso. Eso implica que para cumplir con el objetivo de nuestro trabajo no pueda apelarse a análisis bibliométricos. Por este motivo elucidaremos los diferentes sentidos en los que puede caracterizarse a la memética. Nuestro objetivo es defender que en el área de cantos de aves se pueden encontrar investigaciones que responden a la perspectiva memética en todos los sentidos señalados. Abuso sexual en la infancia es el libro escrito por María Beatriz Müller con el objetivo de dar una explicación del éxito judicial que ha tenido a lo largo de los años el Síndrome de Alienación Parental (SAP), propuesto por el médico Richard Gardner en la década de los 80. A lo largo de la lectura del presente libro se verá cómo la postulación de este supuesto síndrome (SAP) en ámbitos médicos, psicológicos y judiciales, así como otras propuestas carentes (...) de evidencia científica, han generado un contexto claramente perverso en la prevención del abuso sexual, donde “todo se vuelve patas para arriba, no se cree en la palabra de y en los síntomas de los niños y las niñas, las madres protectoras son consideradas instigadoras y promotoras de mentiras, el abuso sexual queda invisibilizado, las víctimas se convierten en victimarios y el depredador en el “pobre padre que no puede ver a sus hijos”” (p. 10). Con este aterrador panorama de la situación actual de muchos países en relación con la prevención del abuso sexual de niños, niñas y adolescentes, la licenciada Müller realiza una exposición muy bien documentada y de fluida lectura sobre los distintos mitos, construcciones e injusticias alrededor de este tema. Esta entrevista se hizo a uno de los miembros de la Academia Hondureña de la Lengua, Víctor Manuel Ramos. Entre los aportes que el académico expresó, fue su contribución a la comunidad intelectual a través de estudios lingüísticos y literarios. En concreto, estos se apreciaron en el Diccionario de las Lenguas de Honduras; Literatura y su producción literaria de índole infantil. Para que ello fuera posible, el entrevistado comentó cómo fue su proceso de formación, el cual fue un tanto complejo, (...) ya que tuvo que descartar algunas filiaciones y presuntas voliciones, tales como las que pretendía hallar desde la Medicina. Finalmente, lo que se concluye de esta conversación es el logro que se puede conseguir para la sociedad después de que uno se prepara concienzudamente, sin obviar el aprendizaje que se deriva de la experiencia personal. La doctrina establecida por la Corte Suprema de Justicia de la Argentina en relación a los crímenes de lesa humanidad cometidos durante la última dictadura militar, expresamente declaraba la obligación del Estado de investigar y juzgar a los responsables de su comisión. La Corte no sólo caracterizó dichos delitos, sino que también estableció que no eran susceptibles de amnistía, indulto, ni prescripción. Pero, en el año 2017 dictó el fallo “Muiña” donde, por voto mayoritario, decidió otorgarle el beneficio del “2 (...) por 1” a un condenado por dichos delitos. La consecuencia fue su inmediata libertad por el vencimiento de la condena. La respuesta de la sociedad fue clara. Con diversas manifestaciones, la sociedad civil, las instituciones y las personalidades públicas se declararon en contra de la sentencia. Más aún, del voto de los mismos jueces se observan expresiones que denotan un gran pesar a la hora de tomar la decisión. Más precisamente, sostenían estar ante un dilema. En este trabajo, lejos de realizar un análisis de la interpretación jurídica que se efectuó en la sentencia, se propone trabajar sobre el concepto de dilema y la posibilidad de aplicación en el presente caso. La finalidad concreta es indagar si se está ante un dilema y en su caso si los jueces utilizan este concepto como un arma argumentativa para lograr adhesión o compasión de la opinión pública. En este sentido, se comenzará relatando el marco jurídico del fallo, donde se describirá la historia judicial de Muiña y los argumentos dados por el voto mayoritario y el minoritario de la Corte. Luego, se realizará un análisis del concepto de dilema, para reconstruirlo sobre la base de dos grandes posturas: Una lógica conceptual y otra fenomenológica. Posteriormente, se realizará un examen de la dimensión institucional del derecho y la moralidad judicial, para - finalmente - poder intentar responder si se está efectivamente ante un dilema. The paper seeks to show how the world of everyday human cognition might be treated as an object of ontological investigation in its own right. The paper is influenced by work on affordances and prototypicality of psychologists such as Gibson and Rosch, by work on cognitive universals of the anthropologist Robin Horton, and by work of Patrick Hayes and others on ‘naive’ or ‘qualitative physics’. It defends a thesis to the effect that there is, at the heart of common (...) sense, a theoretical core of true propositions pertaining to mesoscopic objects, and that the latter are to be understood as relating mereologically to the objects studied by physical science. Hay doble pulsión en el centro de la discusión del razonamiento deductivo. Una conduce aparentemente a la abstracción y dominios arbitrarios, mientras que la otra conduce a la concreción y la dependencia del contenido. El objetivo de esta investigación es diseñar, aplicar y validar un instrumento de evaluación que nos permita corroborar si el razonamiento deductivo maneja reglas lógicas o contenidos. La muestra de estudio se compuso de 80 participantes (edad 18-77 años). El test consta de 60 ítems categorizados en: (...) formalidad, integrabilidad, complejidad y modalidad. Los resultados ponen de manifiesto la fiabilidad del test de razonamiento deductivo con un alpha de Cronbach. 775 y con un índice de validación. 850 para el índice de inteligencia no verbal (INV) del RIAS. Cómo conclusión inferimos que el razonador deductivo no dispone de un cuerpo preciso de reglas generales deductivas, sino que usa colecciones de reglas heurísticas cada vez menos abstractas. “Hay momentos en la vida en los que la cuestión de saber si se puede pensar distinto de como se piensa o percibir distinto de como se ve es indispensable para seguir contemplando o reflexionando” (Foucault, 2003, p. 8). Esta declaración foucaultiana es la que impulsa la voluntad genealógica que presenta este ensayo, así como su pretensión proyectiva para pensar hoy la educación. El momento filosófico crítico consiste en volver sobre las prácticas que día a día llevamos a cabo y (...) configuran nuestras vidas y nuestras instituciones. Este es necesario para realimentar y reorientar la savia de las instituciones, y especialmente la savia de nuestras instituciones académicas, suelo en el cual se teje la sustancia ética que posteriormente dará lugar a la articulación social. Si se aplica el elemento crítico que la actividad filosófica supone a la experiencia de la educación, entendiendo por ella la correlación dentro de una cultura entre campos de saber, tipos de normatividad y formas de subjetividad, podemos preguntarnos: qué es la educación y qué función desempeña hoy con respecto al ejercicio mismo del pensamiento en un contexto atravesado por las nuevas tecnologías y la IA. Hay dos supuestos sobre el valor epistémico que guían las discusiones más recientes sobre éste. El primero es que hay algo bueno con respecto a la creencia verdadera. El segundo supuesto es que es posible que dos creencias difieran en su valor incluso si ambas creencias son igualmente correctas. El veritista tiene fácil explicar el primer supuesto, pero tiene más difícil explicar el segundo. Para explicarlo, el veritista tiene que mostrar que las creencias verdaderas pueden diferir en su valor porque (...) encarnan diferentes valores de bienes derivativos. El veritista tiene que proporcionarnos una historia de cómo es posible que pares de creencias verdaderas difieran en su valor epistémico no-instrumental. La forma más prometedora que una explicación de este tipo puede tomar, en mi opinión, apela al trabajo de Sosa (2007) sobre el valor epistémico y la naturaleza del conocimiento. Según la postura de Sosa, el conocimiento es un tipo de logro, un tipo de éxito que es atribuible al sujeto y a sus habilidades. Estos logros, nos sugiere, son más valiosos que un caso de éxito atribuible a la suerte y que no constituye un logro. Presentaré algunas dificultades potenciales para su postura y consideraré si tiene los recursos para lidiar con ellas. Voy a delinear los detalles de una postura alternativa que evade estas dificultades. Tal postura retiene el análisis del conocimiento de Sosa, pero requiere que revisemos algunas propuestas veritistas sobre el valor epistémico. La postura revisada nos proporciona algunas herramientas que serán útiles al tratar de ofrecer una teoría de la creencia racional o diestra. (shrink)

Definiciones de epistemología hay muchas, al igual que clases y estilos. Sin embargo, más allá de esta diversidad, es necesario contar con una definición básica que guíe nuestra comprensión del tema. Dos serán las preguntas que nos ayuden a ello en este artículo: a) ¿qué es la epistemología? y b) ¿para qué le sirve al científico?

Conceptual engineers have made hay over the differences of their metaphilosophy from those of conceptual analysts. In this article, I argue that the differences are not as great as conceptual engineers have, perhaps rhetorically, made them seem. That is, conceptual analysts asking ‘What is X?’ questions can do much the same work that conceptual engineers can do with ‘What is X for?’ questions, at least if conceptual analysts self-understand their activity as a revisionary enterprise. I show this with a study (...) of Russell's metaphilosophy, which was just such a revisionary conception of conceptual analysis. (shrink)

Nadie sabe lo que quiere la Justicia porque la justicia no se deja escribir. Cuando digo escribir, digo instituir. La Justicia no se deja instituir. Con ello debe lidiar la actividad judicial, con el límite mismo, con la propia imposibilidad. Límite que exhibe oculto que hay algo allí que no hace cuerpo. Que hay algo que el orden de lo simbólico no logra apresar. Legendre decía: en occidente, instituir es escribir. Instituir a los hombres es ante todo, escribirlos, inscribirlos, ¿marcar (...) sus cuerpos? Kafka lo sabía bien. La democracia enfrenta también un desafío similar: asumir que el signo de lo ilimitado la acompaña en el regazo mismo que la dialéctica de la modernidad le ofrece. Los escritores, señala Milner, han descripto lo ilimitado para condenar sus consecuencias y sustraerse a ellas, como el caso de Rousseau, o para constatarlas y combatirlas mediante estrategias de inversión, de Baudelaire a Brecht.Arrasar con la diferencia es no soportar el límite, aquello que hace borde, aquello que no se deja decir. En otras palabras no aceptar la falta en el lenguaje. El presente trabajo pretende mostrar que es, precisamente, el punto de cruce que constituye el límite mismo, el lugar que aloja un encuentro posible entre justicia y democratización. El límite, lejos de clausurar, posibilita aquel enlace, lo augura. Es a nivel del lenguaje que esta relación requiere ser situada. Democratizar la lengua supone horizontalizarla, en otras palabras, abogar por la apertura y circulación del sentido. Son las teorías críticas del derecho las que aportan las herramientas necesarias para pensar esta articulación. Como señala Cárcova, es en el campo del sentido en donde el derecho adquiere su especificidad y produce los efectos que le son propios. Profundizar la democracia desde el campo jurídico exige, ante todo, democratizar al derecho mismo. (shrink)

Hay una profundidad en la letra, entre las letras, que solo la lectura es capaz de enunciar. Enunciación que evoca la pregunta por la violencia de la palabra misma, su ambición de significar. La letra, en cambio, es un acontecer sutil. No hay escritor ni lector que pueda estrecharla, reducirla, asfixiar su siempre prosódica pulsión. Hay otros signos que la letra codicia -dice Jabes- signos borrados que el gesto reproduce en lo que nombra. El presente trabajo pretende interrogar la tradición (...) de la interpretación jurídica occidental emprendiendo la tarea de una restauración: la de la lectura midrashica como modo otro de interpretación. Como advierte Legendre, el armazón lógico de nuestros sistemas jurídicos sostenido sobre un derecho romano canónico como su representación histórica se instituyó sobre la marca de un silencio: la represión de cualquier sistema de interpretación disonante, juzgados como contrarios a la Razón por la tradición del derecho romano cristianizado. ¿Cómo leer esta censura? Muy pronto uno de nosotros se destacó por su capacidad creadora y su curiosidad filosófica: era Juan Larreta. Es así que, a pesar de haber iniciado tarde su formación, descolló como filósofo de mérito tanto en la Argentina como en el exterior. Presidente de la Sociedad Argentina de Análisis (...) Filosófico (SADAF) durante dos períodos, obtuvo el Diploma al M érito en Filosofía de la Fundación Konex en el 2006 y fue nombrado miembro honorario de la Sociedad Española de Filosofía Analítica (SEFA) en 2010. Organizó seminarios y dictó conferencias en centros de estudios filosóficos y en universidades argentinas y extranjeras, en cuyas publicaciones escribió numerosos artículos de singular valía, todos ellos caracterizados por su originalidad, su irreverente desafío al sentido común y sus ingeniosos experimentos mentales (thought experiments). Esta despedida dolorosa se empeña en acercar a la memoria recuerdos queridos de circunstancias compartidas con este amigo excepcional. fue nuestro centro: en su casa organizó, durante muchos años, seminarios de filosofía, de economía y, junto con María Elisa, esas reuniones cinéfilas de divertidas, sorprendentes y variadas interpretaciones... Vào ngày 19/4/2024 vừa qua, Tuyên bố New York về Ý thức của Động vật đã được công bố tại một hội nghị "Khoa học Mới nổi về Ý thức của Động vật" được tổ chức tại Đại học New York. Tuyên bố New York là một nỗ lực để thể hiện sự đồng thuận của giới khoa học về sự tồn tại trải nghiệm ý thức ở tất cả các loài có xương sống (bao gồm tất cả các loài (...) bò sát, lưỡng cư và cá) và nhiều loài không xương sống (bao gồm, ít nhất là, các loài mực ống, giáp xác mười chân và côn trùng). Về mặt khoa học, Tuyên bố New York là một bước tiến bộ lớn cho nhân loại, nhưng nó cũng sẽ khiến cho nhiều người có ý thức hơn về các thách thức đạo đức liên quan đến động vật có trải nghiệm ý thức. Bài viết này sẽ bàn về các cách tiếp cận triết học đối với vấn đề đạo đức của việc giết các sinh vật có tri giác để từ đó chỉ ra nan đề đạo đức đang hiện hữu trong xã hội loài người: Để duy trì sự tồn tại của con người, loài được xem là có đạo đức, thì chúng ta lại vi phạm đạo đức của chính chúng ta, là sát sinh các loài có giá trị nội tại, ý thức, hay tri giác khác. Nan đề đạo đức này đã tồn tại trong xã hội loài người từ rất lâu trước đây. Nhiều giải pháp đã được đề xuất và ứng dụng vào thực tế nhầm giải quyết nan đề này, như cách tiếp cận bất bạo lực và ăn chay của Phật giáo, việc áp dụng luật Hồi giáo và các nghi lễ thiêng liêng đối với động vật trong Hồi giáo, các phòng trào đòi quyền cho động vật và thực hiện tuyệt chủng tự nguyện ở các nước phương Tây, hay chế biến thịt sử dụng tế bào động vật. Tuy nhiên, dù cách nào đi nữa thì hiện nay chúng ta vẫn chưa thể hoàn toàn giải quyết được nan đề đạo đức, đó là các sinh vật có tri giác vẫn tiếp tục bị giết vì sự sinh tồn của con người. Chúng tôi cho rằng giải pháp khả thi nhất hiện nay đó là thay đổi văn hóa tiêu dùng thực phẩm ở hiện tại, xây dựng các giá trị văn hóa thặng dư sinh thái, và thúc đẩy các giải pháp hòa bình. Đại dịch COVID-19 đã gây ra những diễn biến phức tạp, khó lường và tác động đến nhiều mặt của đời sống xã hội, lĩnh vực giáo dục cũng không nằm ngoài tác động đó. Học sinh được trải nghiệm học tập trực tuyến và có những khoảng thời gian “bất thường” rời xa trường lớp, bạn bè và tự học ở nhà (Hoang, 2020; Tran, 2020). Các hoạt động khoa học và giáo dục cũng chịu tác động không nhỏ (...) (Vuong, 2018). Đời sống vật chất lẫn tinh thần của đội ngũ giáo viên cả trong nước lẫn giáo viên nước ngoài đi dạy tại các quốc gia đều bị suy giảm (Vu et al., 2020). Đã có gần 42.000 giáo viên phải hoãn hợp đồng làm việc và không có lương, trong đó có 29.700 giáo viên mẫu giáo bỗng chốc trở nên thất nghiệp và phải làm các công việc thời vụ để đáp ứng đời sống thường nhật (Bich Thanh, 2020). Khoảng 70% các tổ chức giáo dục tư nhân có thể sẽ phá sản khi không thể lưu động đủ chi trả các loại hình tài chính khác nhau (Nguyen, 2020). Rất nhiều trường học đang lo lắng về tình trạng không mong muốn này bởi giáo viên sẽ không thể đảm bảo chất lượng công việc khi mà chất lượng cuộc sống của họ cũng đang bị đe dọa (Canrinus et al., 2012). Hơn nữa, hiệu suất làm việc giáo viên được cho là yếu tố tác động quan trọng và có ảnh hưởng nhiều nhất đến học sinh (Darling-Hammond and Youngs, 2002; Staiger and Rockoff, 2010), so với các tác động bên ngoài như lòng yêu nghề, cách diễn đạt, sự tương tác hay mối quan hệ giữa giáo viên và học sinh (Marsh and Bailey, 1991).
